The petitioner Sanjay Sahani apprehends his arrest in Trial No. 4484 of 2014 arising out of Complaint Case No. 1954 of 2012, registered for the offences punishable under Section 498A and some other Sections of the Indian Penal Code. The informant wife made allegation against the petitioner that he subjected her to physical and mental torture and also neglected her.
Learned counsel for the petitioner submits that the petitioner is ready to keep his wife.
It appears from the orders of the learned Sessions Judge that efforts were made for reconciliation but the petitioner
Patna High Court Cr.Misc. No.368 of 2015 (2) dt.09-01-2015 did not turn up in the court on the date fixed for reconciliation although wife was present. On behalf of the petitioner, prayer was made to dispose of the case without making efforts for reconciliation.
Considering the facts aforesaid, the petitioner is directed to surrender before the court below and the court below i.e. learned Judicial Magistrate, 1st Class, Muzaffarpur will enlarge the petitioner provisionally on bail for one month on furnishing bail bond of Rs. 10,000/- (Ten Thousand) to its own satisfaction in connection with Trial No. 4484 of 2014 arising out of Complaint Case No. 1954 of 2012 and make efforts for reconciliation. If the dispute between the husband and the wife is not resolved the court below shall pass order in accordance with law on its own merit.
