The petitioner is apprehending his arrest in a case instituted under Sections 341, 323, 380, 498A, 386 of the Indian Penal Code and 3⁄4 of the D.P. Act.
The prosecution story, in brief, is that one Pratima Devi filed a complaint petition being Complaint Case No.460 of 2014 alleging therein that she was married with the petitioner in the year 2011 and after marriage she went to her sasural but she was humiliated saying that she is blackish and also demanded a motorcycle and Rs.1,00,000/- for doing business. It is further alleged that on 15.11.2013 she was ousted, for which a panchayati was held but the husband of the complainant did not agree to keep her without fulfillment of dowry.
Patna High Court Cr.Misc. No.26373 of 2015 (2) dt.20-07-2015 On behalf of the petitioner, it is submitted that the petitioner is ready to keep the informant but the same is not acceptable to her. It is further submitted that the petitioner is ready to deposit an amount of Rs.1,500/- per month in the court below, which shall be released in favour of the complainant. On behalf of the State, it is submitted that the petitioner is named in the complaint petition and is the husband of the complainant.
Considering the aforesaid facts, it is directed that the petitioner shall deposit an amount of Rs.1,500/- per month in the Court below, which shall be released in favour of the complainant. Let the above named petitioner, in the event of his arrest/surrender in the court below within a period of four weeks from today, be released on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Sri D. Kumar, Ist Class Judicial Magistrate, East Champaran at Motihari in connection with Kesariya P.S. Case No.140 of 2014, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
