JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 22-08-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Section509 of the Indian Penal Code and Section-12 of the POSCO Act. Petitioner is languishing in jail custody since 24-052016 on the accusation that he along with co-accused Sonu Sah passed filthy comments against the informant's daughter but submission on behalf of the petitioner is that there was communal tension between two communities and prior to institution of the present case, both communities had lodged cases against each others and the present case is also result of the aforesaid communal tension.

Considering the above-said facts and circumstances of

No.35032 of 2016 (2) dt.22-08-2016 2/2 the case as well as submission of the parties, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Obra P.S.
