The petitioners are apprehending their arrest in a case registered for the offences punishable under sections 406, 420, 147, 323,504, 120B/34 of the Indian Penal Code It is alleged that petitioner Vibhu Jha persuaded the complainant to purchase a tractor and consequently the hehas given Rs 1,50,000/- to the coaccused Kavi Shankar Jha but the complainant was supplied one old tractor till the delivery of the new tractor. Subsequently complainant gave Rs. 50000/- to Vibhu Jha. But new tractor was not supplied and old tractor was also taken away by the petitioners.

Patna High Court Cr.Misc. No.202 of 2015 (2) dt.07-01-2015 It is submitted by the learned counsel for the petitioners that there is no proof with regard to the payment of money to the petitioners and statement to this fact has been made in paragraph 11 to the petition.

Considering the aforesaid facts, let the petitioners in the event of their arrest or surrender in the court below within a period of six weeks from today be released on anticipatory bail on furnishing bail bonds of Rs. 10000/- (ten thousand) with two sureties of like amount each to the satisfaction of C.J.M, Araria in connection with above noted case subject to the conditions as laid down under section 438(2) Cr.P. C.
