JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 19-04-2017 Heard learned counsel for the petitioner and learned A.P.P. representing the State.
The petitioner wants to renew his prayer of bail which was earlier rejected vide Criminal Misc. No. 11203 of 2016 by order dated 02.05.2016 by this Court on the ground that the petitioner is suffering in custody since 21.10.2015. Up till now only one prosecution witness has been examined and in near future the trial is not likely to be concluded. The learned A.P.P. opposes the prayer of bail by submitting that son the the deceased has stated that the petitioner was armed with fire arm and fire arm injury has been found on the person of the deceased.
In the facts and circumstances stated above, finding
Patna High Court Cr.Misc. No.13232 of 2017 (3) dt.19-04-2017 2/2 no good ground for reconsideration of prayer of bail, again prayer of bail of the petitioner stands rejected.
However, the trial court is directed to expedite the trial and conclude the same as early as possible, preferably within three months from the date of receipt/production of a copy of this order after taking the same on priority basis, failing which, the petitioner, if at no fault, may be at liberty to renew his prayer of bail.
