JUSTICE BIRENDRA PRASAD VERMA ORAL ORDER 08-01-2016 The petitioner is aggrieved by the order dated 15.07.2013 passed in Mutation Revision Case No. 29 of 2012-13 by the respondent Additional Collector, Nalanda, as contained in Annexure-5, whereby the aforesaid mutation revision case filed on behalf of the respondent no.8 has been allowed and the orders passed by the original authority as also the appellate authority have been set aside and reversed.
In the considered opinion of this Court, against the impugned revisional order, the petitioner has an alternative and equally efficacious remedy before the learned Bihar Land Tribunal, Patna in view of the provisions contained in Section 9 of the Bihar Land Tribunal Act, 2009.
In above view of the matter, the present writ petition
Patna High Court CWJC No.25307 of 2013 (3) dt.08-01-2016 2/2 is dismissed, but liberty is granted to the petitioner to approach the learned Bihar Land Tribunal, Patna for grant of appropriate relief (s) with respect to the lands in question as also with respect to the impugned revisional order dated 15.07.2013, as contained in Annexure-5 to the writ petition. I.A.No. 2609 of 2015 stands, accordingly, disposed of.
