The petitioner seeks regular bail in connection with G.R.P.S. Barauni Rail P.S. Case No. 221 of 2017 for the offences punishable under Section(s) 414 of the Indian Penal Code. The allegation is that police apprehended the petitioner while conducting checking on the railway station and three mobile phones are said to have been recovered from the petitioner. The learned counsel for the petitioner submits that the alleged recovery of three mobile phones from the petitioner has not been stated to be those which might have been stolen ones. It is further submitted that petitioner is having a clean antecedent and languishing in custody since 10.11.2017.

Having regard to the facts and circumstances of the case, the

No.28663 of 2018 (3) dt.21-05-2018 2/2 petitioner, above named, are directed to be released on bail on furnishing bail bonds of Rs.10,000/- (rupees Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Railway, Barauni, Begusarai in connection with G.R.P.S. Barauni Rail P.S. Case No. 221 of In view of the fact that the petitioner is an accused in two other cases under Section 379 of the Indian Penal Code, I deem it fit and proper to direct that the petitioner shall mark his attendance before the concerned police station on every Monday of the week at 10 A.M. and co-operate in the investigation. Their failure to mark attendance before the concerned police station on two consecutive dates would render the present order void. (Mohit Kumar Shah, J) Sanjeev/- U T
