ANJANA MISHRA ORAL ORDER 17-09-2019 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 19.01.2019 in connection with Forbesganj P.S. Case No. 446 of 2017 (G.R.No. 2103 of 2017), registered for the offence, punishable under Sections 399 and 402 of the Indian Penal Code. Learned counsel for the petitioner submits that the petitioner has been remanded in connection with the present case on mere suspicion on the basis of the statements made before the police by the accused persons, who was allegedly arrested from the place of occurrence. It is further submitted that subsequent to the arrest in connection with Forbesganj P.S. Case No. 43 of 2018, he has been remanded in several other

No.44828 of 2019(3) dt.17-09-2019 2/3 cases, including the present case and the main accused persons, namely, Santosh Kumar Yadav, Anil Yadav, Cahandan Yadav @ Chanda Kumar Yadav @ Ashok Kumar Yadav, who took the name of this petitioner, have been extended the privilege of bail, vide orders dated 22.09.2019, 09.11.2017 and 12.12.2017, respectively. It is also submitted that the petitioner is willing to make himself available as and when required by the court below and shall not abuse the privilege of bail, if extended to him. Considering the aforementioned facts and circumstances, let the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the court of learned CJM, Araria in connection with Forbesganj P.S. Case No 446 of 2017 (G.R. No.2103 of 2017), subject to the following conditions:-

(1) One of the bailors will be his own blood relative, preferably, father, mother, brother, sister and/or his wife.

2. The petitioner shall not indulge himself in any similar offence till conclusion of the trial.

3. The petitioner shall remain physically present in court on each and every date during trial and in the event of failure on two consecutive dates without sufficient reasons, his
