The petitioner has filed the instant application for grant of regular bail in connection with Special Case no. 222 of 2020 arising out of Forbisganj (Simraha) P.S. Case no. 146 of 2020 registered under sections 30(a) and 38 (c) of the Bihar Prohibition and Excise Act, 2016.

As per allegation in the FIR, 30 litres of country liquor was recovered and the petitioner was arrested in front of his house.

The application for bail is opposed by learned APP for the State.

Having heard learned counsel for the parties and taking into consideration the materials on record including the petitioner being in custody since 25.2.2020 and not having any criminal antecedent, the Court is inclined to enlarge the

Patna High Court CR. MISC. No.37539 of 2020(2) dt.04-02-2021 2/2 petitioner on bail. The petitioner is directed to be enlarged on bail in connection with Special Case no. 222 of 2020 arising out of Forbisganj (Simraha) P.S. Case no. 146 of 2020 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned 2nd Additional Session Judge-cum-Special Judge, Araria.
