The petitioner nos. 2,3 and 4 are apprehending their arrest in connection with Kateya P.S. Case No. 83 of 2014 registered for the offences punishable under Sections 341, 323, 324, 307/34 of the Indian Penal Code.
Learned counsel for the petitioners submits that there is case and counter case between the parties with regard to some land dispute. It is further submitted that the injuries, purported to have been inflicted were found to be simple in nature. Learned counsel for the State, on perusal of the case diary, submits that save and except the injuries, there is no further
Patna High Court Cr.Misc. No.26651 of 2015 (4) dt.09-11-2015 material in the case diary to implicate the petitioners in the present case.
Considering the aforesaid submissions and also the fact the petitioners have no criminal antecedents, let the petitioners, namely, Gudi Rai @ Gudi Devi, Deepak Rai and Nilu Rai @ Nilu Kumari, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Gopalganj in connection with Kateya P.S. Case No. 83 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C..
