The petitioner seeks bail in a case instituted under Section 47(a) of Bihar Excise (Amendment) Act, 2016. It is alleged that 75 bottles of different brands of foreign wine is said to have been recovered from the vehicle of the petitioner.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 07.09.2016. The charge sheet has been submitted in the present case. There is no allegation of tampering of witnesses alleged against the petitioner. It is alleged that 75 bottles of different brands of foreign liquor is said to have been recovered from the car of the petitioner. The petitioner has

Patna High Court Cr.Misc. No.50978 of 2016 (2) dt.28-11-2016 2/2 got no knowledge regarding the said foreign liquor. There is no compliance of Section 100 of the Cr.P.C. The other co-accused has been granted bail vide Cr. Misc. No. 50695 of 2016. On behalf of the state, it has been submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Nawada, in connection with Rajauli P.S. Case No. 225 of 2016.
