The petitioner, already in custody, seeks bail in connection with Jai Nagar P.S.Case No. 326 of 2017 registered under Sections 302, 394 and 120B of the Indian penal Code. Learned counsel for the petitioner submits that there is no allegation or any evidence against the petitioner of committing robbery, the only material transpired against her is that there is recovery of Rs. 5000/- Indian currency and Rs. 20,000/- Nepali currency and which was made after confessional statement of Md. Arif, nephew of the petitioner and it was not in the knowledge of the petitioner that he has given stolen money to keep with her.

Having considered the aforesaid facts and circumstances, the petitioner, namely, Nazama Khatoon, is directed to be released on bail upon furnishing bail bond of Rs. 10,000/- with

Patna High Court Cr.Misc. No.13692 of 2018(3) dt.02-05-2018 2/2 two sureties of the like amount each to the satisfaction of the learned CJM, Madhubani in connection with Jai Nagar P.S. Case No. 326 of 2017.
