JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 04-09-2019 Heard learned counsel for the petitioner, the State and perused the case diary.

Petitioner is an accused in a case registered for the offence under sections 392 and 412 of the Indian Penal Code. Petitioner along with his two accomplices have been alleged to have beaten the informant, a delivery staff of a company, took away his mobile phone, cash worth Rs.10,000/- and 11 parcels from his bag.

Learned counsel for the petitioner submits that the allegation against the petitioner is false and save and except confessional statement of co-accused Hemant Kumar, nothing incriminating has been recovered from his possession. Petitioner has got no criminal antecedent and he is in custody since 2.4.2019. No test identification parade has been conducted in the case till date.

No.36542 of 2019(3) dt.04-09-2019 2/2 Considering the facts of the case, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Bhagalpur in Industrial Police Station Case No. 32 of 2019, subject to the condition that the petitioner shall fully co-operate with the investigation and trial of the case, failing which the Court below shall be at liberty to cancel the bail bond of the petitioner.
