1. Heard learned counsel for the petitioners and learned APP for the State.

2. The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 115(2), 126(2), 351(2), 352 and 109 of the B.N.S.

3. The learned counsel for the petitioner submits that the petitioners are persons with clean antecedent and the informant alleges that on 28.02.2026 at 11:00 PM Santosh barged in her house and tried to outrage her modesty and also assaulted her, on alarm her husband and other family members

No.39967 of 2026(2) dt.01-07-2026 2/3 came when accused persons assaulted her and her husband by lathi, further Santosh assaulted her husband by an iron rod causing injury on head while other accused persons assaulted her by lathi causing fracture of left arm and Santosh snatched chain of her mother-in-law and even assaulted and when villages gathered accused fled.

The learned counsel for the petitioner submits that petitioners have been falsely implicated in the instant case by the informant, it is next submitted that from perusal of the allegation as alleged in the FIR, it would manifest that thrust of the allegation is against Santosh who is not a petitioner in the instant case and as far as petitioners are concerned, the allegation against them is general and omnibus in nature and petitioners are not criminals.

5. Learned A.P.P. for the State opposes the anticipatory bail application.

6. Considering the submissions made by the learned counsel for the petitioners, the petitioners, above-named, in the event of his arrest or surrender before the learned Court below within a period of six weeks, is directed to be released on anticipatory bail on his furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like

Patna High Court CR. MISC. No.39967 of 2026(2) dt.01-07-2026 3/3 amount each to the satisfaction of the learned Trial Court in connection with Jhajha P. S. Case No. 87 of 2026, subject to the conditions laid down under Section 482(2) of the B.N.S.S.
