The petitioner apprehends his arrest in Naugachia P.S. Case No. 202 of 2014, registered for the offences punishable under Sections 302, 201 and 34 of the Indian Penal Code. Rajesh Mandal the husband of the deceased Hemanti Devi alleged that his wife had gone for training along with Ashish Kumar Das @ Ashok Ravidas, but Ashish Kumar Das @ Ashok Ravidas informed him that his wife Hemanti Devi is missing in Naugachia market. The informant further alleged that after sometime the dead body of his wife was recovered and it appears that she was strangulated to death. The informant suspected that Ashish Kumar Das @ Ashok Ravidas with the help of Pramod Ravidas and Mahanth Ravidas strangulated his wife to death.

Patna High Court Cr.Misc. No.688 of 2015 (3) dt.30-01-2015 Learned counsel for the petitioner submits that the petitioner was not seen along with the deceased Hemanti Devi at any point of time. Even during the course of investigation, the police did not collect any evidence to show the hand of the petitioner in the alleged killing of Hemanti Devi. Having considered the facts that except suspicion, there is no material on record to show the involvement of the petitioner in killing of Hemanti Devi, the petitioner, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Naugachia in connection with Naugachia P.S. Case No. 202 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
