ANJANA MISHRA ORAL ORDER 02-05-2018 Heard learned counsel for the petitioners and learned counsel for the State.

The petitioners are in custody since 22.11.2017 in connection with Bihariganj P.S. Case No. 286 of 2017 for the offence registered under Sections 302/34 of the Indian Penal Code.

Learned counsel for the petitioners submits that the petitioners are not specifically named as having fired on the deceased but have been said to be present at the place of occurrence. It is further submitted that even in the case diary, there is no further material so as to implicate the present petitioners, and at best, they can be treated as a member of the MOB.

Patna High Court Cr.Misc. No.19997 of 2018 (3) dt.02-05-2018 Considering the aforesaid facts and circumstances of the case and that the petitioner has no criminal antecedent, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Judicial Magistrate, 1st Class, Udakishunganj, Madhepura in connection with Bihariganj P.S. Case No. 286 of 2017.
