JUSTICE SUDHIR SINGH ORAL ORDER 29-09-2015 Heard learned counsel for the petitioner and the State. The petitioner is apprehending his arrest in a case instituted under Sections 447, 323, 341, 307/34 of the Indian Penal Code.

The prosecution story, in brief, is that the all named accused persons caught hold Dilip Roy and assaulted him by lathi and petitioner gave Chabiya blow on the head. It is also alleged that earlier the informant was shot at by the petitioner. On behalf of the petitioner has been submitted that the petitioner has got no criminal antecedent. It is a case and counter case. From perusal of para 16 of the case diary, it appears that the injury is simple in nature.

On behalf of the State, it has been submitted that

Patna High Court Cr.Misc. No.27841 of 2015 (3) dt.29-09-2015 2/2 the petitioner is named in the FIR.

Considering the aforesaid facts, let the above named petitioner, in the event of his arrest or surrender in the court below within a period of four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned J.M.,1st Class, Katihar in connection with Kursela P.S.Case No. 13 of 2015, subject to the conditions as laid down u/s 438(2) Cr.P.C.
