The petitioner apprehends his arrest in a case under Sections 408, 409 and 420/34 of the Indian Penal Code. The petitioner is a Panchayat Secretary of Gram Panchayat Nachap who misappropriated a huge amount for purchasing solar light against the circular of the Government of Bihar.
It is submitted that similarly situated co-accused persons, namely, Birendra Kumar Singh, Sipahi Ram and Brij Kumar Pandey, have already been enlarged on anticipatory bail. Considering the aforesaid facts, the petitioner, above named, in the event of his arrest or surrender in the court below within a period of four weeks from the date of receipt/production
Patna High Court Cr.Misc. No.27005 of 2015 (2) dt.20-07-2015 of this order, shall be released on bail in connection with Murar P.S.Case No. 51 of 2014 on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Buxar, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
