The petitioner seeks bail in a case instituted under Sections 302 and 120/34 of the Indian Penal Code. Prosecution case, in brief, as per informant, is that informant's husband (deceased) had given loan to the accused persons and on demand of pay back the same, he (deceased) was killed.

It has been submitted on behalf of petitioner that he is in custody since 27.9.2016. He has got no criminal antecedent. No allegation of tampering of witnesses is alleged against petitioner. General and omnibus allegation has been made against all the accused persons. No specific overt act or injury has been attributed against petitioner. The case has been instituted after six months of the occurrence. Other co-accused has been granted bail vide Cr. Misc. no. 389049 of 2016.

On behalf of the State and the informant, it is submitted that petitioner is named in the F.I.R.

No.53562 of 2016 (2) dt.22-12-2016 2/2 Considering the aforesaid facts and circumstances, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Begusarai, in connection with Khodawandpur (Chhaurahi) P.S. Case no. 263 of 2014.
