Counsel for the petitioner is permitted to make necessary correction in para 13 of the bail application. Petitioner seeks bail in Masaurhi P.S. Case No.850 of 2018 instituted for the offence under Section(s) 302, 201, 120-B/34 Indian Penal Code.

It is alleged in the written report that son of the informant was living in the house of Nana and Nani. The informant got information that his son has been killed. It is further alleged that his mother-in-law told that his son was playing gambling with petitioner and other accused as named in the written report. They have killed him with knife.

Patna High Court CR. MISC. No.37675 of 2019(4) dt.30-07-2019 2/2 Counsel for the petitioner submits that there is general and omnibus allegation against the petitioner. Counsel for the petitioner further submits that coaccused, Md. Imtiyaz @ Alam, has already been granted regular bail by co-ordinate Bench of this Court by order dated 26.04.2019 passed in Cr. Misc. No.8661 of 2019. Petitioner is in custody since 09.11.2018.

In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the SDJM, Masaurhi, in connection with Masaurhi P.S. Case No.850 of 2018, subject to the condition that both the bailors shall be close relative of the petitioner.
