Petitioner, already in custody, seeks bail in connection with Bariarpur PS Case No.4 of 2017, registered under Sections 302, 307, 34 of the Indian Penal Code as well as under Section 27 of the Arms Act.
Allegation is that there was land dispute with accused persons, them came along with three unknown persons and shot at the wife and daughter of the informant causing death of the informant's wife.
Learned counsel for the petitioner submits that the petitioner has been made accused after ten months of the alleged occurrence and the only material is that the petitioner was seen in the market and suspicion is raised, neither he was put on TIP
Patna High Court Cr.Misc. No.14310 of 2018(3) dt.02-05-2018 2/2 nor any other incriminating evidence has been collected against him and he has only one criminal antecedent under Section 307 of the Indian Penal Code and has been in custody since 04.01.2018 and Kundan Kumar, FIR named accused, against whom there is specific allegation and enmity has been admitted to bail by a co-ordinate Bench of this Court vide Cr. Misc. No.55400 of 2017 on 12.12.2017.
Having considered the aforesaid facts and circumstances, petitioner Suraj Yadav is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Munger in connection with Bariarpur PS Case No.4 of 2017.
