JUSTICE DINESH KUMAR SINGH ORAL ORDER 07-07-2015 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 147,149,387,341,323,447,420,467,468,471,504,506 and 120B of the Indian Penal Code.

The prosecution case is that the informant purchased 8 katha of land of Khata no. 203, khesra no. 319 in Mauza Suja vide registered sale deed on 21.11.1978. On 11.4.2015 when the informant went to start construction work then the accused persons including the petitioners abused and obstructed the construction work and demanded rupees ten lacs as extortion and due to assault

Patna High Court Cr.Misc. No.26585 of 2015 (2) dt.07-07-2015 2/2 the informant became unconscious.

It is submitted by the learned counsel for the petitioners that the petitioners claim to have purchased the land in question from Laddan Mian through sale deed and the same was mutated in favour of the petitioners and rent receipt was also granted. Statement has been made in paragraph 3 of the petition that the petitioners have no criminal antecedent.

Considering the accusation in the background of dispute with regard to the title of the land in question, let the above named petitioners be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned CJM, Begusarai in connection with Begusarai Town P.S. Case No. 185 of 2015 subject to the conditions as laid down under Section 438(2) Cr.P.C. (Dinesh Kumar Singh, J) Anil/- U T
