====================================================== CORAM: HONOURABLE MR. JUSTICE BIRENDRA KUMAR ORAL ORDER 09-02-2021 Let the defects be removed within four weeks. Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is languishing in custody for the offences punishable under Sections 363/366/379 of the Indian Penal Code.

Allegation against the petitioner and others is of kidnapping of the married lady for the purpose of marriage. The victim stated that she wants to live with her husband and not with the petitioner in her statement under Section 164 Cr.P.C. The petitioner is in custody since 02.05.2018. In the past twice the prayer for bail of the petitioner was refused by a coordinate Bench of this Court with direction to the trial Judge to expedite and conclude the trial. The trial is

Considering the period already undergone by the petitioner, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Sessions Trial No.601 of 2019, arising out of Darpa P.S. Case No.75 of 2017, with following conditions: (a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below.

(b) The petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.

(c) The petitioner shall not leave the country without permission of the trial Court.
