This is an application for bail in connection with Town P.S.Case No. 377 of 2016 registered for the offences punishable under Sections 302 and 498A of the Indian Penal Code.

Petitioner is husband and there is allegation of murder of wife against the petitioner.

It has been submitted on behalf of the petitioner that at the time of occurrence petitioner was not present. Further it has been submitted that he is only earning member of the family and whole family members have been implicated in this case and he is in custody for eight months.

Heard learned APP also, who has opposed the prayer

Patna High Court Cr.Misc. No.9571 of 2017 (2) dt.12-04-2017 2/2 for bail stating that Doctor has found that due to throttling. Having heard both sides and considering the facts and circumstances of the case, I am not inclined to grant bail to the petitioner.

However, as the petitioner is in custody, learned trial court is directed to expedite the trial and try to conclude the same within a period of nine months.

Accordingly, this application is dismissed.
