JUSTICE DINESH KUMAR SINGH ORAL ORDER 03-07-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 279, 380, 337, 504 and 307/34 of the Indian Penal Code.
It is alleged that on protest being made for dashing the nephew of the informant by car this petitioner caused injury with revolver to the son of the informant Pawan Kumar Mishra. It is submitted by learned counsel for the petitioner that the injured in his statement stated that he could not see who actually fired and the petitioner has maliciously been roped in the present case since he is an Army personal, though, the injury has been found to be grievous.
Considering the fact that the injured has not named the
Patna High Court Cr.Misc. No.26588 of 2015 (2) dt.03-07-2015 2/2 petitioner, it is a case for consideration of regular bail of the petitioner.
Let the learned court below consider the prayer for regular bail of the petitioner if he surrenders within a period of six weeks in connection with Guthani P.S. Case No. 91 of 2014 pending in the court of learned CJM, Siwan.
Since the petitioner is an Army personal, it is expected from the learned court below to dispose of the regular bail application of the petitioner preferably on the same day. Accordingly, the application is disposed of.
