The petitioner is languishing in custody since 26.07.2016 in a case registered for the offences punishable under Sections 8/20(A)(i)/29 of the Narcotic Drugs and Psychotropic Substances Act, 1985.
Prosecution case is that the informant Ratna Kishore Jha, Station House Officer during the vehicle checking intercepted one person who disclosed his name as, petitioner, Shukhoo Yadav @ Sukhu Yadav and stated that he was fleeing away since he was carrying Ganja and from whose possession one plastic bag tied on the motorcycle containing 600 grams of Ganja along with Rs.10840/- were recovered.
Learned counsel for the petitioner submits that the
Patna High Court Cr.Misc. No.38894 of 2016 (2) dt.22-09-2016 2/2 recovery is of small quantity and petitioner has no criminal antecedent.
Mr. Arun Kumar, learned counsel for the State does not controvert the quantity of recovery.
Considering the small quantity of recovery and coupled with the statement made in paragraph 3 of the petition that the petitioner has no criminal antecedent, let the petitioner, above, named, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge-cum-Special Judge, Nalanda, Biharsharif in connection with Hilsa P.S. Case No. 363 of 2016.
