JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 04-07-2018 Heard learned counsel for the petitioner and State. The petitioner is in custody in connection with Bandhuwa Kurwa P.S. Case No. 44 of 2017 for the offence under Sections 302, 201/34 of the Indian Penal Code. Learned counsel submits that the petitioner has got no criminal antecedent. Learned counsel further submits that the case was registered against unknown. He further submits the name of the petitioner has been surfaced on the basis of confessional statement of co-accused. The petitioner is languishing in jail since 14.10.2017.
Considering the fact that the petitioner has remained in custody for nearly 9 months and he has no criminal antecedent, the petitioner, named above, is directed to be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) with
Patna High Court Cr.Misc. No.28038 of 2018 (3) dt.04-07-2018 2/2 two sureties of the like amount each to the satisfaction of Additional Sessions Judge-I, Banka in connection with S.T. No. 21 of 2018, arising out of Bandhuwa Kurawa P.S. Case No. 44 of 2017.
