The petitioner is accused in connection with Giriyak P.S. Case No. 191 of 2016, registered under Sections 363 and 366 of the Indian Penal Code.
Regarding missing of Sinu Kumari, daughter of informant, aged about 18 years, Giriyak P.S. Case No. 191 of 2016 was instituted against unknown.
Learned counsel for the petitioner submits that, in course of investigation, daughter of informant was recovered by the police with Laxman Kumar and she stated about moving with Laxman Kumar and performing marriage with him according to
Patna High Court Cr.Misc. No.13490 of 2017 (2) dt.24-03-2017 her own sweet will. But later on, her statement was recorded under Section 164 Cr.P.C. in which, she stated about her kidnapping by Laxman Kumar and this petitioner and two others boarded her in the vehicle. It is further submitted that petitioner has no criminal antecedent and is in custody since 02.12.2016. Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Nalanda, in connection with Giriyak P.S. Case No. 191 of 2016. Out of two sureties, one surety must be the close relative of the petitioner.
