Petitioners are in custody since 13.02.2017 in connection with Sadar P.S. Case No. 74 of 2017 registered under Sections 414, 420, 294-A of the Indian Penal Code and Section 4/5 of Ban on Lottery (Bihar) Act 1993 and Section 7(3) of Lottery Regulation Act.
Learned counsel for the petitioners has submitted that the petitioners have not committed any offence and falsely been implicated in this case by the police. In fact, the petitioners have nothing to do with the alleged lottery and have been made accused on the basis of confessional statement of co-accused, Rakesh Ranjan @ Sunni. Nothing incriminating has been recovered form the conscious
Patna High Court Cr.Misc. No.17527 of 2017 (2) dt.19-04-2017 possession of these petitioners. The petitioners are rotting in custody for the last one and half months.
Considering the nature of accusation, let the petitioners, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand rupees only) each with two sureties of the like amount each to the satisfaction of the learned C.J.M., Purnea in connection with Sadar P.S.
