JUSTICE JYOTI SARAN ORAL ORDER 27-03-2015 Heard Mr. Kamala Prasad Roy, learned counsel appearing for the petitioner and learned counsel for the State. The grievance of the petitioner is that some persons have encroached upon a Gairmazarua Aam Paine and Hunder situated on plot nos.1464 and 382 in Village- Bhathar, Block Tharthari in the district of Nalanda.

Even while making such grievance it is manifest from the writ petition that no formal application as required under the provisions of the Bihar Public Land Encroachment Act, 1956 has been filed by the petitioner raising such grievance before the statutory authority.

In such circumstances no direction can be issued and

Patna High Court CWJC No.937 of 2015 (2) dt.27-03-2015 the writ petition is disposed of with a liberty to the petitioner to raise his grievance before the statutory authority and which shall be considered and disposed of accordingly.
