JUSTICE BIRENDRA KUMAR ORAL ORDER 29-03-2017 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.
Petitioners are languishing in custody for the offences punishable under Sections 147, 18, 149 and 302/34 of the Indian Penal Code.
It appears that similarly situated some other coaccused have already been allowed bail by different co-ordinate Benches of this Court vide Cr.Misc.No.22479 of 2016, Cr.Misc.No.23309 of 2016, Cr.Misc.No.22912 of 2016 and Cr.Misc. No.30766 of 2016.
Considering the aforesaid facts, let petitioners, above named, be enlarged on bail on furnishing bail bond of
Patna High Court Cr.Misc. No.14345 of 2017 (2) dt.29-03-2017 Rs.10,000/-(Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Khagaria/Successor Court, in connection with Morkahi P.S. Case No.91 of 2015, with condition that petitioners shall fully cooperate with the investigation and trial of the case, failing which the Court-below shall be at liberty to take steps for cancellation of the bail-bonds of the petitioners in this case.
