This is an application for bail in connection with Kochadhaman P.S.Case No. 200 of 2016 registered for the offences punishable under Sections 406 and 420 of the Indian Penal Code.

Allegation against the petitioner is that on the plea of sending the informant to foreign country for job he has taken Rs.80,000/- from him and though he had prepared pass port, etc. petitioner was to return from Delhi.

It has been submitted on behalf of the petitioner that petitioner is ready to pay back the amount to the informant and as per instruction petitioner has paid some amount to the informant.

Having heard both sides and considering the aforesaid facts and circumstances, this application is disposed of with the direction to the court below to issue notice to the informant and in their presence if the petitioner is ready to return the balance amount to the informant in instalments to be decided by the court concerned, then the petitioner will be released on bail provisionally to its satisfaction and after full payment the bail bond of the petitioner shall be confirmed.
