The petitioner seeks bail in connection with Rosera P.S. Case No. 321/2017, registered for the offences punishable under sections 395, 412 and 120(B) of the Indian Penal Code. As per FIR, six unknown miscreants committed robbery in the house of informant and took away ornaments and cash amount.
It has been submitted that this petitioner is not named in the FIR. He is a businessman dealing with jewellery and has been apprehended merely on suspicion. Police allegedly recorded his confession. The recovered articles belong to this petitioner. The petitioner has not been put on TIP till the date and has been

No.29465 of 2018 (3) dt.29-06-2018 2/2 languishing in custody since 18.01.2018 having clean antecedent except one case registered under sections 341, 323 and 504/34 of the Indian Penal Code in which he is on bail. The learned Additional Public Prosecutor on the other hand opposed the submission.
Considering the facts and circumstances of the case, the prayer for bail of the petitioner is allowed and he is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-I, Rosera (Samastipur) in connection with Rosera P.S. Case No. 321/2017, subject to the following conditions:- (i) One of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the concerned Court.
(ii) The petitioner will not induce any witness or tamper with the evidence.
(iii) The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.
