This is an application for bail in connection with Sessions Trial No. 56 of 2015 arising out of Barharia P.S. Case No. 408 of 2014, registered for the offences punishable under Section 302 of the Indian Penal Code.
Petitioner is the husband and the case is under Section 302 IPC.
It has been submitted on behalf of the petitioner that he is in custody since 10.9.2014 and in spite of that the case has not been concluded up till now.
Heard learned APP also.
Having heard both sides and in view of the fact that the petitioner is in custody for more than two and half years and the case is fixed for trial. As such, learned trial court is
Patna High Court Cr.Misc. No.15193 of 2017 (4) dt.27-04-2017 directed to expedite the trial of the petitioner and conclude the same within a reasonable period preferably within nine months. In the meantime, the Superintendent of Police, Siwan is also directed to ensure the attendance of witnesses in the case on the date fixed so as the case may be concluded within the prescribed period as the petitioner is in custody for more than two years.
Accordingly, this application is dismissed.
