JUSTICE MADHURESH PRASAD ORAL ORDER 30-01-2018 Heard counsel for the petitioner and the State. In respect of the appointment to the post of Anganwari Sevika at Centre no. 180 under Gram Panchayat Raj Aurai, village Halimpur, Block Aurai, District Muzaffarpur, the petitioner had made some complaint. It appears from the counter affidavit that in view of order dated 01.06.2007 passed by the Commissioner, Tirhuit Division, Muzaffarpur (respondent no.5), the Deputy Director, Department of Social Welfare Tirhut Commissionary, Muzaffarpur (respondent no.4)

Patna High Court CWJC No.55 of 2015 (4) dt.30-01-2018 has submitted his enquiry report to the former. However, till date no final decision has been taken by the respondent no. 5 in respect of the said enquiry report.

In view of the aforesaid circumstances, since final decision is to be taken by respondent no.5 as per the averment made by the respondents themselves in the counter affidavit, the writ petition is disposed of with observation that respondent no.5 would take a final decision in respect of the enquiry report addressing the petitioner's claim after noticing and hearing the parties concerned in accordance with law. The exercise should be completed expeditiously and preferably within eight weeks from the date of receipt/production of a copy of this order. (Madhuresh Prasad, J) Shashi.
