JUSTICE SUDHIR SINGH ORAL ORDER 23-09-2015 Heard learned counsel for the petitioner and learned counsel for the State The petitioner is apprehending his arrest in connection with Mohania P.S. Case No. 88 of 2015 for the offences instituted under Sections 307, 333, 353, 436, 147, 148, 149, 323, 435, 338, 337, 332, 448, 341, 342, 504, 427 of the IPC and 27 of the Arms Act.

The prosecution story, in brief, is that an irate mob of 200-250 people protesting against the assault and death of a Teacher committed by some person, reached the Mohania Police Station, indulged in vandalism, ransacked the police station, assaulted causing injury to many police personnel and set fire the vehicles seized and parked in the Mohania Police Station and

Patna High Court Cr.Misc. No.26605 of 2015 (3) dt.23-09-2015 2/2 vehicles wee also set on fire which were out side the police station and blocked the National Highway for several hours. It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. It is further submitted that the petitioner has been made accused in the present case due to mistake of fact. Other co-accused have been granted anticipatory bail by this Court vide Cr. Misc. Nos. 19408/2015, 20173/2015 and 22266/2015.

On behalf of the State it has been submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail in the event of his arrest or surrender before the learned court below within a period of four weeks from today in connection with Mohania P.S. Case No. 88/2015 on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Kaimur at Bhabua, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
