JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 11-03-2022 Heard learned counsel for the petitioner and learned A.P.P for the State through video conferencing. The petitioner seeks bail in Gopalpur P.S. Case No. 184 of 2020, registered for the offence punishable under Sections 406, 420, 379 of the Indian Penal Code. As per the prosecution case, driver of the informant disappeared his tractor loaded with sand under a conspiracy with a view to sell the same.

It is submitted on behalf of the petitioner that petitioner is not named in the FIR. No looted article has been recovered from his possession. Looted tractor has been recovered from possession of co-accused. Petitioner is in custody since 21.01.2021.

Patna High Court CR. MISC. No.50854 of 2021(3) dt.11-03-2022 2/2 Learned APP however, vehemently opposed the prayer for bail and submitted that looted mobile has been recovered from possession of this petitioner. Considering the fact that looted mobile has been recovered from possession of this petitioner and he is having criminal antecedent, I am not inclined to enlarge the petitioner above-named on bail.
