JUSTICE DINESH KUMAR SINGH ORAL ORDER 03-07-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 147,148,149,341,324,307 and 504/34 of the Indian Penal Code and section 27 of the Arms Act.
It is alleged that eight accused persons including the petitioner came variously armed and started abusing the informant. On protest being made, on the order of co accused Sanjay Yadav, Ram Lochan Yadad fired which did not hit the informant, thereafter co accused Shankar Yadav (non petitioner) caused injury with fire arm on the left knee of the informant and co accused Pramod Yadav (non petitioner) caused fire arm injury on the left hand of the informant.
It is submitted by the learned counsel for the petitioner that
Patna High Court Cr.Misc. No.26925 of 2015 (2) dt.03-07-2015 2/2 the accusation of firing is not against the petitioner and in the background of land dispute the petitioner has been roped in the present case.
Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned JM Ist Class, Jhanjharpur, Madhubani in connection with Laukahi P.S. Case No. 71 of 2013 subject to the conditions as laid down under Section 438(2) Cr.P.C. (Dinesh Kumar Singh, J) Anil/- U T
