The petitioner seeks bail in a case registered under Sections 147, 148, 149, 341, 324, 307,504 and 506 of the Indian Penal Code.

It has been submitted that there is no repetition of blow. The injury was simple in nature. The injury report (Annexure 3) shows that the injury has been found on the neck of the injured. The petitioner is said to be in jail custody since 10.02.2017.

It appears from the impugned order that there is case and counter case between the parties.

Considering the aforesaid facts and circumstances of

Patna High Court Cr.Misc. No.19794 of 2017 (2) dt.02-05-2017 2/2 the case, the prayer for bail of the petitioner is allowed. Let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/-( ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saharsa, in Bihra P.S.Case No. 26 of 2017, subject to the condition that both the bailors will be close relatives of the petitioner.
