2. The petitioner has preferred this application for grant of regular bail in connection with Sheikhpura (Mahila) P.S. Case No. 14 of 2025 dated 22.04.2025 registered for the offences punishable u/ss 70(2) read with section 3(5) of the Indian Penal Code.

3. As per the prosecution case, it is alleged that the informant's daughter used to talk with the co-accused Rajiv Kumar on mobile for about one year. On 21.04.2025, when her daughter left for nature call, in the meantime, the co-accused Rajiv Kumar with the association of the petitioner and the other

Patna High Court CR. MISC. No.38306 of 2025(2) dt.01-07-2025 2/2 co-accused persons is alleged to have committed rape on the informant's minor daughter.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. The specific allegation of committing rape is against the co-accused Rajiv Kumar. There is no allegation of sexual assault against the petitioner. The petitioner has clean antecedent as stated in para 3 of the bail petition. The petitioner is in custody since 23.04.2025.

5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.

Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Sheikhpura in connection with Sheikhpura (Mahila) P.S. Case No. 14 of 2025.

7. The application stands allowed.
