JUSTICE NAVANITI PRASAD SINGH ORAL ORDER 08-06-2015 The petitioner apprehends arrest in relation to Sheohar SC/ST P.S. Case No. 1 of 2015 instituted under Sections 341,323,354,379,504/34 of the Indian Penal Code. Learned counsel for the petitioner states that the petitioner is a fair price shop dealer. The brother of the informant had taken certain foodgrains and refused to pay. When the payment was demanded, the petitioner was assaulted for which the petitioner lodged a case being Sheohar P.S. Case No.8 of 2015. It is only in retaliation to that case that the present case has been lodged naming one son and an employee of the petitioner but admittedly not named the petitioner in the first information report and deliberately under S.C./S.T. Act allegations have been made to ensure the arrest and humiliation of the petitioner.

Patna High Court Cr.Misc. No.17727 of 2015 (2) dt.08-06-2015 Be that as it may, in the facts and circumstances of the case, in the event of his arrest or surrender in the court below within a period of four weeks from today, the petitioner above named shall be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, Sheohar in S.C./S.T. Sheohar P.S. Case No.1 of 2015 subject to all conditions as laid down in Section 438 (2) of the Code of Criminal Procedure.
