Petitioner is languishing in custody since 04.09.2016 in connection with Makhdumpur P.S. Case No. 222/16 for offences punishable under Section 414 of the Indian Penal Code.
The prosecution case, as lodged by the police, is that petitioner along with one another was caught red-handed while snatching a mobile from the passersby and from the possession of another co-accused a mobile was recovered. It has been submitted by the learned counsel for the petitioner that he is innocent, bears no criminal history, nothing has been recovered from his conscious possession and that
Patna High Court Cr.Misc. No.54695 of 2016 (2) dt.22-12-2016 2/2 another co-accused on similar allegation has since been granted the privilege of bail by a Coordinate Bench of this Court in Cr. Misc. No. 50122 of 2016 on 22.11.2016.
However, learned APP for the State submits that the petitioner is named in the First Information Report, hence, opposes the prayer for bail.
Be that as it may, since petitioner has no criminal history and that another co-accused has since been granted the privilege of bail, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Jehanabad in connection with Makhdumpur P.S. Case No.222/16.
