Heard learned counsel for the petitioner, learned A.P.P. for the State and learned counsel for the informant. The petitioner seeks regular bail in connection with Bounsi P.S. Case No. 39 of 2022 lodged under Sections 302, 201/34 of the I.P.C.
As per the prosecution case, the informant has disclosed that her son was called by the accused other than the present petitioner and subsequently, upon search, his son was not traceable. But on the next day, his dead body was recovered from a well. It has been stated that there was a Panchayati took place between the informant and the petitioner. It has been raised suspicion that only due to this reason, the accused
Patna High Court CR. MISC. No.40447 of 2022(3) dt.23-11-2022 2/3 persons have called his son and murdered. Thereafter, thrown his dead body in a well.
Learned counsel for the petitioner submits that petitioner is innocent and has committed no offence. He further submits that he is in custody since 20.02.2020. Counsel further submits that from the contents of the F.I.R., it is clear that there is a specific allegation against the son of the petitioner and one other accused, namely, Chattish Raut to call the son of the informant but name of the present petitioner has been added on the suspicion subsequently.
Learned counsel for the State opposes the prayer for bail.
Learned counsel for the informant vehemently opposes the prayer for bail and submits that there is a role of son and father in killing of the informant's son. In the present facts and circumstances of this case and the submissions made above, let the petitioner above named, be granted bail on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) with two sureties of the like amount each to the satisfaction of learned Addl. Session Judge-III Banka, District-Banka in connection with Bounsi P.S. Case No. 39 of 2022, subject to the conditions as laid down under Section
Patna High Court CR. MISC. No.40447 of 2022(3) dt.23-11-2022 3/3 437(3) of Cr.P.C.
With this observation, the bail application stands allowed.
