JUSTICE SUDHIR SINGH ORAL ORDER 22-07-2015 Head learned counsel for the petitioners and the State. The petitioners are apprehending their arrest in a case instituted under Sections 341, 323, 448, 504 and 506 of the Indian Penal Code and Section 3(i)(x) of SC/ST (Prevention of Atrocities) Act.
It is alleged by the informant(Rashmi Priya) that on 5.5.2015 Birendra Kumar and his servant suddenly entered into her house. Abused her by naming her caste Chamar, black coloured and ugly face. He also threatened to shoot and to commit rape with her. It is further alleged that wife of Birendra Kumar used to say the mother of informant as DAIN asking her black colour and ugly face.
Patna High Court Cr.Misc. No.27198 of 2015 (2) dt.22-07-2015 2/2 It has been submitted on behalf of the petitioners that all sections of Indian Penal Code are bailable except Section of SC/ST Act. It has been further submitted that from perusal of FIR it appears that the alleged occurrence is said to have taken place inside the house and not in public place. On behalf of the State and the informant, it has been submitted that the petitioners have abused the informant. Considering the aforesaid facts, let the above named petitioners, in the event of their arrest or surrender in the court below within a period of four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned A.C.J.M., Patna City in connection with Agamkuan P.S.Case No.195/2015, subject to the conditions as laid down u/s 438(2) Cr.P.C.
