The petitioner seeks bail in connection with Patna Junction (Rajendra Nagar, Terminal) P.S. Case No.394 of 2016 registered under Section 273 of the Indian Penal Code besides Section 30(a) of the Bihar Excise (Amendment) Act, 2016. The accusation is that on seeing the police party, the petitioner started to flee away but was apprehended and on search, 260 pouches, each containing 200 ml. country made liquor, were recovered from his possession.

Learned counsel appearing on behalf of the petitioner submits that the petitioner having no criminal antecedent is in

Patna High Court Cr.Misc. No.20103 of 2017 (2) dt.12-05-2017 2/2 custody since 09.12.2016.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, Railway, Patna, in connection with Patna Junction (Rajendra Nagar, Terminal) P.S. Case No.394 of 2016.
