The petitioners, who are in custody, seek bail in connection with Barachatti P.S.Case No. 428 of 2016 registered under Sections 272, 273 and 120B of the Indian penal Code and 30(a), 32(2), 38 and 47 of the Bihar Prohibition And Excise Act, 2016.
Allegation, in brief, is that the police stopped two vehicles. It is alleged that petitioners were sitting in Indigo car and were escorting Innova car from which approximately 203 litres of foreign liquor were recovered.
Learned counsel for the petitioners submitted that the
Patna High Court Cr.Misc. No.53751 of 2016 (2) dt.14-12-2016 2/2 petitioners were boarding Indigo car and there is no any relationship either with the Innova car or the driver or its owner and no recovery has been made from the vehicle of the petitioners and they have also got no criminal antecedent. Considering the aforesaid facts and circumstances, in particular, there appears no recovery being made from the conscious possession of the petitioners, they are directed to be released on bail upon furnishing bail bonds of Rs. 10,000/- each with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Sherghati, Gaya in connection with Barachatti P.S. Case No. 428 of 2016 (G.R. No. 1776 of 2016). (Arun Kumar, J) Sujit/- U
