JUSTICE SUDHIR SINGH ORAL ORDER 21-07-2015 Heard learned counsel for the petitioner and the State. The petitioner is apprehending his arrest in connection with Mahila P.S.Case no. 39 of 2015 a case instituted under Sections 354 of the Indian Penal Code and Section 3(u)(xi) of SC/ST Act, pending in the court of learned C.J.M., Jehanabad. The prosecution story, in brief, is that the informant I an employee of Jehanabad General Post Office who has alleged that on 01.05.2015 at about 5 P.M. while she was doing her work in her section, in the meantime, the petitioner is said to have attempted to misbehave and caught hold of her hand with bad intention.

It has been submitted on behalf of the petitioner that the petitioner has falsely been implicated in the present case.

Patna High Court Cr.Misc. No.26429 of 2015 (2) dt.21-07-2015 2/2 In fact, the petitioner had made certain directions to the informant being her superior officer and same was not complied with and due to which the present case has been lodged against the petitioner by the informant.

On behalf of the State, it has been submitted that the petitioner is named in the FIR and there is allegation of misbehaving with the informant.

Considering the aforesaid facts, I am not inclined to grant anticipatory bail to the petitioner and same is rejected. However, if the petitioner surrenders in the court below within a period of six weeks in the court below and pray for regular bail, same shall be considered by the court below on its own merit without being prejudiced by this order of rejection taking into account that the petitioner is a government employee, preferably same may be disposed of on the same day.
