JUSTICE SUDHIR SINGH ORAL ORDER 21-07-2015 Heard learned counsel for the petitioner and the State. The petitioner is apprehending his arrest in a case instituted under Sections 365 and 366 of the Indian Penal Code. The prosecution story, in brief, is that suddenly on 25.8.2014 a call came on his father's mobile no. 9709711845 of his minor daughter Babali Kumari from mobile no. 09540087409 and she told that she was married but place could not be traced. Later on the informant knew that petitioner no. 1 Naresh Mahto with the help of his sister Neelam and other family members make a conspiracy and kidnapped Babali Kumari and kept her at unknown place and later on he also knew that with the help of coaccused Neelam and her husband Vinod kept her daughter in Delhi.
Patna High Court Cr.Misc. No.26706 of 2015 (2) dt.21-07-2015 2/2 It has been submitted on behalf of the petitioner that the victim Babli Kumari has married with the petitioner. Subsequently the said Babli Kumari has also made her statement under Section 164 Cr.PC. wherein she has admitted this fact that she has married with the petitioner.
On behalf of the State, it has been submitted that the petitioner is named in the FIR.
Considering the aforesaid facts, let the above named petitioner, in the event of his arrest or surrender in the court below within a period of four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Darbhanga in Laheriasarai P.S.Case No. 395/2014, subject to the conditions as laid down u/s 438(2) Cr.P.C.
