The petitioner seeks bail in a case instituted for the offences under Sections 147, 148, 149, 341, 323, 324, 325, 307, 436, 435, 452 and 380 of the I.P.C.
Allegation is that the accused persons including the petitioner brutally assaulted the informant, her husband and daughters causing grievous injury to them and they also damaged the house hold articles and set the house on fire. It has been submitted on behalf of the petitioner that the petitioner is in custody since 9.5.2016 and the charge sheet has been submitted in the present case. There is no allegation of tampering of witnesses alleged against the petitioner. The
Patna High Court Cr.Misc. No.52597 of 2016 (2) dt.14-12-2016 2/2 petitioner has falsely been implicated in the present case. General and omnibus allegation has been made. No specific injury has been attributed against the petitioner. The other co-accused has been granted bail vide Annexure-2 to the present application. On behalf of the State and the learned counsel for the informant, it is submitted that the petitioner is named in the F.I.R. Considering the aforesaid facts and circumstances, it is directed that the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Muzaffarpur in connection with Muzaffarpur Town P.S. case No.612 of 2015.
