The petitioner is in custody in connection with Chanpatia P.S. Case No. 119 of 2015 for the offences punishable under sections 147, 148, 149, 342, 323, 307 and 302 of the Indian Penal Code.
There is allegation against this petitioner that he has assaulted the informant and his family members with lathi and iron rod.
From perusal of the order, it transpires that after investigation, police has submitted final form against this petitioner, however, the learned Magistrate differing with the
Patna High Court Cr.Misc. No.20229 of 2017 (3) dt.30-05-2017 2/2 police report took cognizance.
In paragraph 3 of the bail petition, the petitioner has mentioned that he has no criminal antecedent. Having regard to the facts and circumstances that the petitioner has no criminal antecedent and at the relevant time police after investigation submitted final form against the petitioner and the fact that similarly situated co-accused Md. Habibullah Ansari and Abid Ansari have been granted bail by this Hon'ble Court in Cr. Misc. No. 20796 of 2014 on the ground of parity, I am inclined to enlarge the petitioner, named above, on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-V, Bettiah, West Champaran, in connection with Chanpatia P.S. Case No. 119 of 2015 on the condition that the petitioner will cooperate in the trial and will not, in any manner, influence the evidence or the witnesses. (Anil Kumar Upadhyay, J) Ravi/- U T
